9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WING SNOB, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

IN ANY CASE, THE AGGREGATE LIABILITY OF WING SNOB AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO WING SNOB IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

Some states do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation may not apply to you. In such jurisdictions, Wing Snob's liability shall be limited to the maximum extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Wing Snob and its owners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any and all claims, liabilities, damages, losses, judgments, awards, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

We will attempt to resolve the dispute informally within thirty (30) days of receiving your written notice. If this class action waiver is found unenforceable, then the mandatory arbitration provision shall not apply.

13.4 Small Claims Court Exception

Notwithstanding the foregoing, either party may bring an individual claim in a small claims court of competent jurisdiction provided the claim qualifies and remains in that court.
